i was asked to paint a picture (i am new to the world of art but i have some understanding of copyrights) to paint a picture of an elk in a calendar that he liked anyway i understand that i cannot do this unless i paint it to make it not look like the photo how can i do this i do not understand would a few extra rocks make it so that it would be okay
the animal is also breathing out with his breath visible and i would kind of like to do it since i cant go out a find an elk and say here please stay and let me paint you
anyway i need your help

As you correctly stated painting from a photograph or other picture gives rise to copywright concerns. Generally speaking the painting that you create must not--to the ordinary observer--look like the picture/photo that you are using. As this issue involves serious copywright concerns, I advise that you consult an attorney to represent you in this matter.
