Breach of Verbal Contract

Can I do anything about a client

lying to me? This client also

holds my HELOC, a Credit Card,

Checking and Savings Account. The

Marketing VP assured me the new

person was not a designer and that I

would always have their business.

This new person was hired over a

year ago and also assured me she

was not a designer. Lately the work

coming to me has lessened, and now

I find myself in a financial quagmire.

The client requests that I provide

them my schedule, and even stated

that I was part of their team. On

numerous occassions the VP urged

me to not get too involved with

other customers because they

wanted me all to themselves. I feel

they have all the benefits of a design

dept. without the overhead. I was

told the Annual Report would be

coming to me. I recently questioned

its whereabouts and was told by the

new employee she was waiting

on copy. A few days later when

the VP called I asked where the copy

for the AR was. He stated the

new employee told him that I was

having a difficult time after eye

surgery, so she worked on it. I am

too old to look for another job, and

finding it difficult to replace them.

Your basic relationship with whom you describe as a client would appear to be that of an independent contractor rather than an employee. Beyond that it is difficult to understand the basis for your claim of a supposed oral breach of a contract, partly because your language may be too full of insider jargon and references to business protocols which make it difficult for the non-initiated to follow. (I haven't the foggiest idea as to what a HELOC is all about.)

You may wish to resubmit this question, clearly identifying the relevant actors in this alleged breach of contract matter and in particular how in fact they may relate to you and to your position vs a vs. the business.
