Legal Question in Business Law in Virginia
business names
I am in the process of starting a small cleaning business and have picked out a name that will descibe my business perfectly. However, after researching this name on the web, I have found that a company in Ohio already uses that name. That company is incorporated and has a logo. My company will not be incorporated. My logo will be different also. My question is; can I use the name I have chosen even though someone else already has that name for their company? My company will be in Virginia.

You can use the name in Va. unless they have a federally registered trademark (and assuming there is no other competing use in Va.)
