Legal Question in Business Law in Virginia
Going out of Business
I put a deposit of $1,800 down for a top for my boat. I just found out that the business never made my top and are closing their business Friday. I asked for my deposit back and the reply was they haven't any money now but when they sell some of the machinery in the store I will get my deposit. I want to know what to do next. When they close their doors I won't have any way to even contact them. The owner of the business does also work for the government, this was just a side business for him.

It is not true that you won't be able to find
them, especially with a lawyer's help, just
becuase they close the shop.
Try to talk them into giving you a written
promise to pay you the deposit when funds allow.
(I hope you also have a receipt on the deposit.)
If he works for the government, he will eventually
be able to pay you back.
It is a fairly serious issue because it looks
like he took your $1800 and SPENT it instead of
holding it in reserve, and then did not deliver
the goods. This could even be a criminal matter.
But it certainly would allow you to sue him.
