Legal Question in Business Law in Virginia

How do I get my credentials off website?

I worked for a company for 4 years and was a top executive. The company grew on and advertised my name with my experience and credentials. Because of some ethical problems the company had i left over 6 months ago. I cannot get them to remove my name and credentials from their web site. i have written letters, called, left voice mails and sent certified letters. They refuse to remove my name and credentials from their website. Any suggestions?

In Virginia, you can ask a court to have an organization remove your name or likeness when they use them for trade perposes without your consent.

Va Code 8.01-40 states, "Any person whose name, portrait, or picture is used without having first obtained the written consent of such person, or if dead, of the surviving consort and if none, of the next of kin, or if a minor, the written consent of his or her parent or guardian, for advertising purposes or for the purposes of trade, such persons may maintain a suit in equity against the person, firm or corporation so using such person's name, portrait, or picture to prevent and restrain the use thereof; and may also sue and recover damage for any injuries sustained by reason of such use..."
