Legal Question in Business Law in Virginia

I am an entertainer living in Rhode Island. I did a performance in Rhode Island but was hired by an entertainment agent in Virginia. (the company is an LLC) I had a contract with them to be paid by 10 days after the performance. (by August 17, 2009) I did not get paid for doing the job. I have repeatedly called and the answer is "the check is in the mail". I finally sent them a certified letter saying that if they did not pay me by a certain date I would file a civil suit. They still have not paid me. I live in Rhode Island and it would be very hard for me to appear in small claims court in Virgina. What should I do to recover my money?

The firm will need to be sued by you in Virginia. You could hire an attorney to file suit in general district court, and after doing so, they might decide to settle up. However, if such were not the case and the matter proceeded to trial, you would, of course, need to appear to testify in the matter.
