How can a foreigner open his company in VA, USA? Does he need to be present or he can open it while he's overseas?

The foreigner may wish to explore the possibility of obtaining an E-2 investor visa
if s/he intends to open a business or invest substantially in an extant U.S. business.
If this foreigner has competent people to act for him or her and
who are lawfully in the United States, there is no reason as to why
s/he necessarily needs to be present in the United States, as far as I
am aware.
