Legal Question in Business Law in Virginia
My lease ends in 90 days, the new owner wants my employee list and contact info 60 days out. I haven't told my employees and wont until 30 days out for fear of them walking. Do I have to provide the info to new owner? If so is there a time frame?
1 Answer from Attorneys
Assuming that your question deals with a commercial rather than private residence lease and that this employee list is a material provision of the contract, then it is likely enforceable by the new owner. (However, concerning your comment as to
your employees likely reaction to this request, you might
want to revisit this issue with the landlord to see if it
might be waived, or, perhaps, modified to some extent that
your employees could live with it without "them walking".
As to the timeframe, that would likely be the time referenced
in the lease itself, or, if none, then the 60 days which
the new owner is requesting which would appear reasonable.
