LLC vs. Terms of Use Agreement
Hello,
My website is an information based website to provide information guiding people to our AdvoCare Independent Distributorship. There is no sales through our site. All sales are actually done through AdvoCare. I am also trying to develop an entire network community and provide as much information on wellness as possible. To cover myself legally, I was hoping to be able to put a Terms of Use Agreement. I did not know if it was necessary to establish an LLC. Please advise when convenient. Thank you.

A Terms of Use Agreement is a great idea, and is something you should definitely have. You do not need to form an LLC to have such an agreement, I also recommend that you form one. An attorney can quickly and easily help you form the LLC and draft up the T&C. Let me know if I can be of any assistance to you.

You will need an agreement to protect your interests and forming an LLC is a good idea as well--though not required to use the agreement. I suggest that you contact an attorney directly to fully assist you in this matter.
