Very likely depends where in the Commonwealth you have in mind for the making of this pornography

which under the Supreme Court's U.S. v. Miller decision of some 40 years ago or so(I believe)is highly dependent upon local community standards for what might be termed its alleged lawfulness. (Federal law if far more important on this issue than state law.)

In other words, down in the Grundy or Bristol areas of the Commonwealth you might find yourself prosecuted for making and selling pornography that would not raise an eyebrow in the Office of Commonwealth's Attorney in Fairfax or Arlington.
