Legal Question in Business Law in Virginia

non compete contract

I'd had working as account sales rep with our local newspaper for more than 20 years. I accepted a sales position with a TV Station and signed a non compete contract. I've been with the TV Station for 9 mos. The newspaper has made me an offer to return in sales/management...and I want to accept the job. Because I was so excited about the position with the TV Station I did not read the non compete(dumb me). Is it possible to get out of this contract???

Re: non compete contract

It may be possible depending on the actual language and terms of the non-compete agreement. In order for a non-compete to be valid, it must be reasonable with regards to time (the amount of time that it restricts competition), geography (the physical area it limits), and scope of duties/competition. An attorney should be consulted to review the non-compete and whether it's reasonable as mentioned above under VA law. Good luck.
