Is a verbal/handshake agreement binding in the state of Virginia? Situation: Son met with a Chesapeake resident who wanted a concrete slab put down for his HVAC unit. Money was given to son by resident by a check and deposited in NFCU account for materials. Materials were bought and job was done in eight hours. Resident agreed to pay $300 for the work done. This was the first week of May and no one can get hold of the resident to get paid the $300. What is your advice? Do you take him to Small Claims court or chalk it up as a loss? Please email. Have pictures of the work completed and receipts of materials bought.

Yes, verbal contracts can be as binding in the Commonwealth as are

those that are written.

Your son could file a mechanics' lien as outlined in Va. Code Sec.

43-3 A. against the property for the value of the work that was performed and which remains unpaid and/or a case in small claims court for this value + court costs.

Either or both.
