Legal Question in Business Law in Virginia
My wife works at a chain of nursing homes in Va. as a Staff Developer. She was recently given, without choice, every 3rd weekend on call to handle management problems of staffing and admitting new patients. Corp. policy says if come in will be paid $200 regardless of actual hours worked in this additional shift. Can they pay her less or nothing if only took an hour or 2 to take care of problem? Also, if takes care of problem on phone, do they have to pay her at all ? She can't leave the area while on call. Also, during the week she will not get paid if uses a PTO day or sick day during week on call. Can they now say this part of her duties and pay her nothing extra for this and on weekends? Can they keep adding extra duties with no extra pay?
