Legal Question in Civil Rights Law in Virginia
April 1 my live in boyfriend broke up wit me and he got his stuff out on april 2. He said everything that was left I could keep. Over a month later his parents are demanding me to give them back a kerosene heater they gave us as a gift. If I do not they will take me to court. It has been over 30 days since he left and he said to keep anything. Can they take me to court and do anything legal against me?
1 Answer from Attorneys
So, let them take you to court and you can then explain to the judge
that they gave this heater as a gift to you and your former boyfriend who in
turn then gave his share of this appliance to you when he moved out.
And, gifts once given, are not reclaimable by the giver(s).
And, if it happens to be small claims court, you could submit a statement
signed by this ex boyfriend attesting to the veracity of your claim(s)
as part of your defense.
