Buying house and sellers still live in it
I bought a house on Sept 26, 2008. The deed has been trasnfered into my name. The sellers still live in it. We have sent a certified letter to them stating they need to be out of the house on Nov 1, 2008. We took out an unlawful legel detainer warrent and go to court tomorrow. Will the judge allow them an extra 30 days to stay there? It was never in the contract for them to stay at the house for any amount of time.

I agree with Mr. Michael E. Hendrickson that seller is now trespasser and has not right whatsoever in the property which has been now transferred in your name. Your petition seeking vacation the seller will succeed.

No, they likely are now considered in law no more than trespassers on property which now belongs to you and should be required by the court to vacate the premises by the date which you stipulated in the letter.
