my cars title and tags are in someone else name they took it back cause i failed to keep insurance on it. is this legal?

No, I wouldn't think so. (Once the car is properly titled in your name, it's yours
and all the responsibility that goes with that, including keeping it insured, and
a previous owner cannot simply take the title back----period.)
Of course, if the title never actually was transferred to you and you were
attempting to buy the vehicle on installment terms and then failed to meet
some or all of those terms, that would be a different issue.
