Legal Question in Civil Rights Law in Virginia

I have a complaint against my old employer regarding civil rights and they returned a statement to my lawyer requesting mediation. I have agreed to the mediation and a date to meet but my old employer keeps changing the date 3 days before we meet. What can I do about it. It has happened 3 times already.
