Legal Question in Civil Rights Law in Virginia

I got a DUI several months ago and am required to complete the ASAP program. I was referred to a local counciling group which meets the ASAP requirements. I am currently in group therapy at this center. The LCSW/Drug Councilor required me to also attend separate one-on-one counciling sessions with them because of my personal problems that were listed in my evaluation forms. In a recent group therapy session, the councilor/ therapist divulged personal information that I discussed during one of our private sessions. I have great concern about my personal information being divulged in the group sessions. Does the therapist/councilor have the right to divulge personal information gained from the one-on-one sessions in the group sessions? Are there confidentiality laws required by all therapists? Thank you.

Whether there are or are not such confidentiality requirements and/or privacy laws that may be applicable to the situation described, you should have the right

to insist of your therapist that no such personal information regarding

your specific situation or case be disclosed in any such future group

discussions or you will have to either seek another ASAP approved counseling group or, if necessary, bring the matter before the court to resolve it.
