Can a company make a civil suit on this after a District Attorney refused to take a case.Because of no criminal evidence.I had proof of permission to take scrap material.Now have lost job getting uneployment since 01-30-07

Yes, the company can file a civil suit against you for damages that they allegedly incurred as a result of what they obviously regard as an unauthorized taking on your part of their scrap material.
The fact that the local prosecutor declined to "paper" the incident as a criminal matter is virtually irrelevant, legally speaking, in regard to the company's civil suit which is now apparently pending against you.
