Legal Question in Civil Rights Law in Virginia

Me and my fiance got into a argument she then left our apt and went to the neighbors to use phone i told her to come back in and i went to grab her and she pulled away and came back in on her own.Then our neighbor called the law and told the cop i knocked her down and forced her back in apt. Then when cop showed up we both said there was nothing physical just argument then he got that statement from neighbor at the same time the cop charged him with possesion of marijuana. So i guess my question is can you take statement from someone who is under the influence of a drug.....
