Legal Question in Civil Rights Law in Virginia
is there a law on needing identification to accept a check
My brother took one of my mother's checks and wrote it out to a store. He is mentally ill, and my mother doesn't want to file charges against him. The check didn't clear her bank, but she paid within 5 days to make it good. The store owner has already filed charges against her(it was under $200). The question is, is the clerk legally responsible for asking for identification from the person writing the check? In other words, could he be sued for accepting the check to begin with from a person who did not even have his name on her check? Thanks,
Heidi

I am not aware of any such law which requires such
checking of a check presenter's identification.
