Legal Question in Civil Rights Law in Virginia

In regards to scrap metal I know that the company can't convict according to the Investigater .But does the Company have a chance as far as a civil suit?Also we have a Attorney that is going to countersue What are our chances? I am 61 years old I drew out my unemployment.I may have a job now through a temp.agency Thursday?? I also had to take out my 401k to help with my wife with the mortgage and other bills.I was not completly vested so I ended up losing the Company's part.I worked there 2 and 1half years.I now have nothing for my retirement.even though it was not that much to start with [4000.00]Thanks
