Legal Question in Civil Rights Law in Virginia

Search and Seizure

If the police come to your home and threaten you in some fashion in order to obtain your permission to search your home, the home you share with someone they suspect of a crime, and you give permission only because of the threats the police made,is the evidence found as a result of that search admissable or is the search even legal?

Re: Search and Seizure

It depends upon the facts of the case. You need to discuss the facts with a lawyer in your area. It's hard to revoke permission after the fact and they have already conducted the search on the basis of consent.

The police are given pretty wide latitude, but if they threatened your life or something on that order, they have certainly ovestepped the bounds of acceptable conduct.
