Legal Question in Civil Rights Law in Virginia
unlawful detention by dept. of corrections
my husband was sentenced to 2 yrs. for a probation violation and the court order stated that he will serve a total of 2 years but the Dept. of corrections said he will serve 5 and this isnt correct and the judge faxed them a new corrected sentencing order but they still willl not correct his release date.Can I file suit against the D.O.C. and if so how do I do that?

Let your husband's former lawyer deal with it, if possible. The lawyer should be able to ascertain the best way to remedy this problem which may involve no more than a clerical glitch
somewhere in the bowels of the D.O.C. bureaucracy.
Needless to say, attempting to file suit against the D.O.C. is not the way to go at this time.
