Legal Question in Civil Rights Law in Virginia

Van Sale

I sold a auto to an individual, my ad stated the good and bad, problems, flaws etc it also stated that leaks had been repaired, found other issues and told about them. They drove and inspected and purchased, called 5 days later and stated was leaking, (we had no issues with leaks when sold). We were honest. Said they would seek legal advise, we told to bring back if not what they wanted and we would refund mony. Not heard anything in over a week. Are we liable since the auto was used.

Re: Van Sale

No, such private sales of goods are normally "AS IS", without warranty or guarantee of any kind. Furthermore, in these kinds of transactions, as a seller, one is only required to answer truthfully the questions which the buyer may ask about the condition of the merchandise. The seller is not even required to disclose to the buyer material defects known to the seller unless the former specifically asks about them.
