Legal Question in Civil Rights Law in Virginia

I was involved in an accident in which I was not at fault. The other party received a ticket and the police report states that he was at fault. The problem is, his insurance company has denied my claim based on his statements and not the police report (which found him at fault) or the ticket he received. I'm confused because I thought that with the police report they wouldn't be able to deny this claim. I will be suing but I don't know if I should go after the guy, his insurance company or both. Please help me answer these questions. I am about to be in debt because of this accident (I didn't have full coverage on my vehicle) and I don't know what to do.

You sue the tortfeasor (the one at fault who caused the accident). His insurance carrier will then either settle or send lawyer(s)into the case to defend him.
