Legal Question in Civil Rights Law in Virginia
it's been four years since I broke my fist to a wall on purpose at my mom's house , but all the damage was fixed and it's been a long since we moved out of there, now I wasnt the only one involved, my mom ex told me to do it, would I be fair to be charged with a crime even if my mother forgave me for it?
1 Answer from Attorneys
If you're being charged in criminal court for the misdemeanor destruction of
property, the applicable statute of limitations would be one year from the date of the incident, and the case should no longer be prosecutable.
However, the owner of the house could still bring charges in civil court against whomever was responsible for causing the damages for up to five years from the date of the alleged destruction of this property.
