Internet Forum Issue with ''Trolls''

A person who spams the forums and causes havoc has recently moved onto personal attacks toward other forum members. He/she started posting annoying messages like ''I KILL U!!11'' and ''I raped my mother.'' and because of this free speech issue, the owner of the forum does not ban this person. However if any illegal activity was conducted, this person could be banned. Is it illegal to harrass people online?

Probably not. But the question remains as to why anyone would want to belong to such a forum which tolerates this kind of scumbaggery in the name of free speech?
