Is is legal for an independent school to take away someone's cell phone and retain possession of it outside of school hours, or overnight?

Likely yes and it happens all the time. Most schools are authorized to seize contraband and other items not allowed on school premises and most students know better. Sometimes you get it back, sometimes you don't.
