Legal Question in Technology Law in Virginia

Shipped to the wrong address

I ordered an external hard drive and

a coffee maker offline and had them

shipped to apt. 419 in my group of

apartment buildings instead of apt.

491 (my apartment). I have

confirmation that atleast one of them

was delivered to 419 by UPS. I've

been unable to make contact with

the tennant despite attempts by

myself and my landlady for almost a

week now. is it illegal for him to keep

the pacakages since they had my

name on them even though they

were shipped to his address? It may

also be relevant that the address i

gave technically doesn't exist as apt.

419 is not in the building number i

gave to the shippers.

Re: Shipped to the wrong address

Mail this apparently uncooperative tenant a demand notice to turn over the misshipped merchandise to you by a date certain.

Then, if such is still not forthcoming from this apparently wrongful distrainer of your personal property, you could file a Warrant in Detinue against him in your local general district court and request in the alternative, that if for whatever reason he cannot (or will not) produce the requested property, that a judgment be entered against him for its fair market value.
