Legal Question in Constitutional Law in Virginia

conceal carry permit

I pled not guilty to a class3 felony in Florida in 1998. I was sentenced and adjudication witheld pending copmpletion of my sentence. I have not been in trouble since. I have purchased a firearm with a background check, but when I applied for the conceal carry permit I was denied saying I lied on my application and that I was convicted of a Felony. My lawyer had explained that after my probation was over that I was not considered a convicted felon and that my rights were restored. After I finished probation I had contacted the ATF and was told wait 3 yrs to purchase a gun and 5 yrs for the permit. I have an appeal hearing next week. Really short notice, but was looking for pointers to help me out. PLEASE HELP!!!!

Re: conceal carry permit

Without reviewing the application for the Virginia permit and the alleged lie which you supposedly committed in completing this application, I doubt that any "pointers" could be offered here that might possibly be useful for your appeal hearing.

(Furthermore, whatever happened in Florida regarding the disposition of your felony case there

may be subject to a different interpretation in Virginia with respect to your eligibility here for the permit to carry a concealed weapon.)
