Legal Question in Constitutional Law in Virginia
detainment
I was asked to enter an officer with a loss prevention person for a company I worked for. The LP person told me that he was conducting interviews in regards to loss prevention procedures. Half way through the so called interview the person stated that my name had come up on his grid about some incidents. At that time the interview changed for company procedure to an interegation. I answered the question in fear of losing my job. At no time did the LP person tell me that I could leave at any time and I didnt ask for fear of losing my job. The LP person did make that the statement that he wanted to give me the opportunity to tell my side of the story so that when he went to human resources they would have my explanation. By telling me that the interview was to go over the store LP standards and then turning to accusation and not telling me I was free to leave at any time isnt this a violation of my constitutional rights? I was misinformed of the intention, I was not asked if i wanted any witness for me to the conversation, and a tape recorder was conviently cut on and off at his discretion.

Re: detainment
No, what you've described in terms of the interview conducted with you by the loss prevention person could not involve any violation of your constitutional rights since no law enforcement personnel or other so-called "state actors" were apparently involved in this matter.
