Legal Question in Construction Law in Virginia
abandoned vehical
I have a customer that has abandoned their crane in our yard. He brought it in for service in Sept 2007, we did the work and he can't pay for it, so it has been sitting in the yard ever since. We have tried calling him, sent someone out to look for him and he avoids us. This is in VA. At what point can I call this abandoned and sell it. It is unregistered.

Unless your contract for the work gives you a right to claim legal ownership of this crane if the customer fails to pay the bill for the work, your safest approach is probably to obtain a judgment(in small claims court if less than 5K)for the amount of your claim and then petition the court for a so-called FiFi writ which should allow you to acquire legal ownersahip of the crane and to sell it in order to satisfy the judgment.
