Legal Question in Construction Law in Virginia

City Water Main Break Damaged Home

A city water main broke on city property in front of my house and flooded my basement with 15'' of water and mud. The city is denying my claim calling it an accident. It is undetermined if my homeowners insurance will pay at this point. If they don't, can I sue the city or do I have any recourse to get reimbursed for damages from either insurance or city?

Re: City Water Main Break Damaged Home

Before you sue the municipality, you should check with a local attorney to determine whether the city might be able to defeat your kind of claim against it by raising the defense of sovereign immunity.
