Legal Question in Construction Law in Virginia
construction damage
Hired a contractor to complete work. Paid after he complete the 1st part. I told him I wasn't satisfied and he said he was coming to correct the problem. He has not and it is going on a month. I am ready to go to small claims court. Do I have a case since we had no written contract but I did pay him with a check and we agreeed verbally. Do I have a good chance of winning my case. I don't know where he lives but I do Know his place of employment.

Re: construction damage
Yes, under these circumstances you should be able to prove your oral contract before a judge of the small claims court. Make sure you have the deputy serve the papers in person on the defendant and not on someone else at the job site, otherwise the service will be invalid and the case could be dismissed.
