Contractors agreement
2 yrs ago I had signed a contractors agreement with a management firm located in NJ. I am located in VA. This firm does management and repairs on retail locations which they contract from another national management firm. Their payment terms when I signed was net 45 days from date of invoice receiptWithout any notification to me they changed their terms to 60 days which I found out after numerous phone calls as to why I was not recieving payments. At this point they are past due on 15 invoices ranging from 158 days past due to two days past due now totaling $2,850.00 past due with $4,475.00 current I call them on a weekly basis asking for payment. Sometimes I'll recieve a payment usually I get excuses or they say payment will be made but never is in the time frame they give. At this rate they will always be past due. In the same ageement I agreed not to solicit/and or accept work directly from any clients, stores, or facilities introduced by them without first recieving written release from the company. How can I convince them to get up to date on money owed, can I charge interest ,how much, have they defaulted the agreement 45 days net to 60without notifying me. If they defaulted can I accept work from the national company

It would seem advisable for you to arrange for a consultation with an attorney who handles commercial contract matters in order for her/him to review this contract and the pertinent facts surrounding the issue and to advise you, accordingly.
