Legal Question in Construction Law in Virginia

Contracts with General Contractors

We signed a contract in August with a contractor to remodel our kitchen and install replacement windows. The kitchen was completed but it is now the middle of November and the windows have not been installed. We were told he would put them in when he ''gets around to it''. Can we legally get out of the contract and hire someone else? To date, we have paid him half of the total cost--including the kitchen and windows. Thank you for your help.

Re: Contracts with General Contractors

Yes, you can "get out of the contract" if in fact it has been breached by the contractor. It would appear that a key element in this regard is whether there was a clear time frame spelled out in the contract in which the contracted work was to have been completed.
