Legal Question in Construction Law in Virginia

Final Payment

Our General Contractor is scheduling the final inspection on our addition to our house. When the final inspection is completed and passed, the General Contractor wants the final payment. The problem is that there is a 32 item punch list that needs to be completed, but none of these will not affect the passing of the final inspection.

If the final payment is not made, the General Contrator has stated that there will be a lien put on the house for the final payment. What are our options? This contractor has past history of not completing punch lists or waiting until the warranty expires.

Re: Final Payment

Put the General Contractor on notice in writing that the final payment will not be forthcoming until all items in the 32 item punch list have been satisfactorily completed.

The business of a lien in this particular situation is nothing but the General Contractor

"blowin' smoke", as they used to say.
