Legal Question in Construction Law in Virginia

General Contractor not paying me for work done

I am asking this for my boyfriend. He was asked to build a deck, and finish some trim work. He is almost finished and cannot find the guy to get paid. He is looking into the mechanic's lein, but is not sure what he needs to do.

He has only been paid part of what he is owed. What legal action can he take if this man does not pay him.

Re: General Contractor not paying me for work done

Your contractor boyfriend should consult with an appropriately experienced attorney regarding the filing of a mechanic's lien as well as any other enforcement actions which may be feasible in this particular circumstance.

Filing a mechanic's lien is a meticulous legal exercise(with numerous potential invalidating pitfalls), and if it is not fully conforming with all of the specified statutory requirements, it can be declared a nullity and, consequently, the filer's well intentioned efforts in vain.
