Legal Question in Construction Law in Virginia
Lien on a state building
We are a voice and data contractor. We are working with an electrical contractor on a Virginia state job. The electrical contractor was not required to provide a bid bond. Can a subcontractor place a lien on a state building in the state of Virginia if the contractor does not pay?

Re: Lien on a state building
No. Mechanics liens cannot be imposed on public property. If the electrical contractor was not the prime contractor (i.e., entity that contracted with the owner), perhaps there is a bond posted by the prime. If not, your only recourse would be to sue the electrical contractor.
