Legal Question in Construction Law in Virginia
mechanic's lien
Contractor terminated for cause - as per terms of contract - about 66% through project. Four months later he files a mechanic's lien, for balance of project $[$90000]. This is for work not performed or materials not provided. Also, his claim is that one sub he used was hired by our new contractor. Now he is filing to enforce claim, Does Virginia have a basic hearing procedure to dismiss this claim or must there be a formal suit filed?
