Legal Question in Construction Law in Virginia
I performed work on a project in Virginia
for a home improvment company based in Maryland. They have paid aprx. 80%
of my invoiced charges, but do not want to pay the remainder. If legal action were to proceed, which jurisdiction takes precedence, that of
the project location, or the company
headquarters location? They do have a
license to do business in Virginia.
1 Answer from Attorneys
The jurisdiction where the company headquarters are located would likely have preference but if the company has a registered agent in the Commonwealth to accept service of process, the action could likely also be filed in Virginia. (The State Corporation Commission in Richmond should be able to verify whether there's such a registered agent.)
