Legal Question in Construction Law in Virginia
trees on property line
We recently had our property surveyed because we suspected our neighbors trees were on our land . Some of them were, some were not,some have grown over the line or their branches overhang it by several feet. What are our options? He says we have none, Is that true?

The trees which have actually been determined to be on your property you could cut down (assuming after having given adequate notice to your neighbor and that he or she is unable to move them). The trees with overhanging branches, you're entitled to have them trimmed back to your neighbor's property line, as long as they're not damaged in the process. (If they're damaged, you're responsible.)
