Legal Question in Consumer Law in Virginia
On 1/3/11 a body shop gave an estimate on repair damages to my vehicle from an accident and on this estimate put down 23 days for repairs. As of now, 23 days later, the shop has not even started on the repairs. I have reached the limit on the rental car that the insurance company allows and I am between a "rock and a hard place". The repairs will take 60 hours to complete, so if the repairs are started as of now, it is going to be almost 2 weeks before the vehicle is ready. I have contacted my insurance company and a rep. did go by the repair shop and the only story that he received that they are waiting on parts. I could understand "waiting on parts"if my vehicle was 1939 Hudson, but it is a 2009 Subaru, 3 days would certainly be a reasonable time for parts.
Now, what are my options? Can this repair shop continue to hold my car and not make repairs? I feel that I am at the mercy of this shop and the insurance company will not extend my rental limit. In my opinion, the shop is "pushing my vehicle" to the rear of their list, so they can do the fast and quick cash jobs because we have had several accidents due to the weather and the shop is taking advantage of the situation.

So, demand that these repair sluggards immediately release your vehicle since
all reasonable time frames have been exhausted and you must now find
another shop to handle the repair.
