My 2000 SUV has a current VA state inspection done in November 2013 and passed emissions. In Feb 2014 I purchased a new truck so the SUV became a static display except for starting and driving on a rare occasion while trying to sell it at fair market value. In July, I noticed the rear brake starting to squeal indicating brake replacement was going to be needed before next inspection. Rather than spending money for the repair, I opted to decrease the price and sell the car with full disclosure of the pending bake pad replacement. Aware of the brake issue, the buyer (a mechanic) performed diagnostic and visual checks on the vehicle, and purchased it "as-is." While driving the SUV home he stated the brakes failed and is threatening me with criminal and civil action. Am I liable?
