Auto Dealer will not return deposit

Went to the auto dealer, got excited about a new car and plunked down $3,000 to get the car ordered. Car got held up in shipping tie-up out of the West Coast so dealer said he would do a ''trade'' with another dealership for the car. In the meantime, changed my mind and subsequently purchased a different car elsewhere. Original dealer refuses to return my deposit even though I have not taken possession of the car, nor have I signed any type of purchase agreement. Do I have any recourse to get my money back? Dealer has said that he was ''put-out'' by getting the car from the other dealership and refuses to bend whenever I go to the dealership to try and get the deposit.

Why would you "plunk down $3000" without anything

in writing as to how you should get the return of the deposit if conditions change?

Now your only options are to try and negotiate a settlement with the dealer, perhaps, offering him no more than $500 or, if that fails, filing your

claim in small claims court for the return of your deposit.
