Auto sales fraud
I was sold a vehicle in may'02. I paid for the car in full with cash. My dealer then kept on making excuses of why he couldn't produce the title. Five months later the dealer has still not produced the title and will not give my money back. I have sent a demand letter which gives him 10 days to produce the title or the original amount that I paid. As of now he has 5 days left and he shows no intention of giving either to me in the given time. He sold a vehicle with out a title and did it so knowing so he says that he has three other people in this situation. The dealer will not give me 30 day tags anymore and my car is now sitting in my drive way. What can I do if he does not produce the title or money in the given time period of the demand letter? And can I get punitive damages for fraud and breach of contract?

Before you consider initiating suit against the dealer, you may wish to make inquiry of the DMV to see exactly what is required under these circumstances to produce a new title. (They may require a statement from the dealer explaining why he cannot produce the title.)
