Legal Question in Consumer Law in Virginia
automobile purchase
I recently puchased, or thought I purchased a vehicle from Bay Kia in Virginia Beach. (Wednesday, April 23rd) Our first trip there was around 2 pm, and after we submitted the inital application, we were told to take the vehicle with us, and come back later that night to sign the paperwork. We left and return around 830 pm. All the paperwork was done, and we were advised of what our payment would be, the interest rate, first payment due date, etc. At no time was there any mention of any problem with finanacing. We returned on Friday to have the vehicle cleaned ....again nothing was mentioned of a problem with financing. Finally, on Monday, April 28th the dealership contacted me to tell me that there was a problem and they weren't able to get the vehicle financed......but if we were willing to trade in our second vehicle, they may be able to get us financed on two brand new vehicles. Are they legally able to get out of a contract after 5 days like that?

If the contract contained a provision(naturally,in very small print)which made your vehicle purchase contingent upon the dealer finding appropriate financing, the answer must be yes.(And, furthermore, if the dealer's second proposal doesn't work out, don't be surprised if you're hit with a mileage charge for the use of the car(s) while they were in your possession.)
