Legal Question in Consumer Law in Virginia
Automobile Repossession
Recently my car was repossessed, although in the
past I had problems but in last six months I was
making payments monthly, having just made a
payment on 7/15/02 and sending another on 8/15/02. I
had maintained contact with the finance company and
informed them on my financial situation and was
reassured that this would not happen. The car is
almost paid for the balance is only $1900. I feel this
action was decietful on their part and very unfair. Was
this legal? and what options do I have? Thank You.

Re: Automobile Repossession
Although you indicate that you had been making payments monthly(within the last six months),it's
not clear how far behind in your payments you actually were, if any, and, if you were behind,
whether you were making a current as well as an arrearage payment in your monthly payment.
Also, it's unclear whether you had an agreement with the finance company to get caught up in your payments, and whether you actually adhered to that agreement.
You should contact immediately the person(s) you spoke with previously at the finance company who assured you that repossession would not occur, and, perhaps, they will be able to assist you in getting your car back. Any future agreement which you come to with the finance company regarding this matter should be reduced to writing.
