Automotive Responsibility
We had an older vehicle serviced at a local garage. The oil filter we provided was forced into the vehicle and caused the oil to spill out as we were transporting the vehicle home. The engine was ruined. The garage did come take the car back but now wants us to pay for the tow. They accept no responsiblity for the situation and want us to pay storage if the car is not removed soon. Do we have any legal standing? We contacted out insurance company; their advice was to consult a lawyer. Thanks!

The key to liability here in your question would seem to turn on the words: "the oil filter we provided was forced into the vehicle and caused the oil to spill out".
What does this precisely mean, i.e., who did the alleged forcing and under what circumstances and
if that's what truly happened, do you as the provider of the apparently ill-fitting oil filter share in any of the responsibility?
